1. Overview
Contego Media respects the intellectual property rights of others and expects users of the Platform to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, we have established the following procedures for addressing claims of copyright infringement.
2. Reporting Copyright Infringement — Notice & Takedown
If you believe that content available on or through Contego Media infringes your copyright, you may submit a written DMCA takedown notice to our designated Copyright Agent (see Section 6 below).
Required Elements of a Valid Takedown Notice
To be effective, your notice must include all of the following:
- Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notice, a representative list of such works.
- Identification of the infringing material on the Platform with sufficient detail for us to locate it (e.g., URL, file name, or description).
- Your contact information — your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement of accuracy and authority, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
Incomplete notices may not be acted upon. We reserve the right to request additional information where necessary.
3. Our Response to Valid Takedown Notices
Upon receipt of a complete and valid takedown notice, we will:
- Acknowledge receipt of the notice within 24 hours.
- Expeditiously remove or disable access to the allegedly infringing content, typically within 5 business days.
- Notify the account holder whose content has been removed, where practicable.
- Provide the account holder with a copy of the takedown notice (with your contact information, unless you request otherwise).
4. Counter-Notice Process
If you are the account holder whose content was removed and you believe the removal was made in error or due to misidentification, you may submit a written counter-notice to our Copyright Agent.
Required Elements of a Valid Counter-Notice
- Identification of the removed material and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your full legal name, mailing address, telephone number, and email address.
- A consent statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Contego Media may be found), and that you will accept service of process from the party who submitted the original takedown notice.
- Your physical or electronic signature.
Upon receipt of a valid counter-notice, we will provide it to the original complainant. If the complainant does not notify us within 10–14 business days that they have initiated a court action, we may, at our discretion, restore the removed content.
5. Repeat Infringer Policy
Contego Media has a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of intellectual property rights. We track DMCA notices and enforcement actions and may permanently terminate accounts that accumulate multiple valid infringement findings.
6. Misuse of the DMCA Process
Submitting a false or materially misrepresented takedown notice or counter-notice may expose you to civil liability under 17 U.S.C. § 512(f), including liability for damages, costs, and attorneys' fees. Please consult a qualified attorney if you are unsure whether material infringes your copyright.
